5. Payment & Subscription Information

Subscription purchases are processed securely by Apple or Google. XXTRA Seat does not store your credit card or banking information.

XXTRA Seat — Terms of Use (EULA)

These Terms of Use (“Terms”) govern your use of the XXTRA Seat mobile app and website (“Service”) operated by XXTRA Seat LLC (“we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

1. Eligibility

To use XXTRA Seat, you must:
Be at least 18 years old
Have the legal capacity to agree to these Terms
Provide accurate and truthful account information
You are responsible for maintaining the confidentiality of your login credentials.

2. User Conduct

You agree to use the Service responsibly and follow all community and safety guidelines. Prohibited behavior includes, but is not limited to:
Harassment, threats, bullying, or abusive behavior
Explicit, pornographic, violent, or hateful content
Impersonation or creating misleading profiles
Discrimination or hate speech
Illegal activities of any kind
Dangerous, reckless, or harmful conduct
Spamming, scamming, or soliciting money
Attempting to damage, disrupt, or hack the platform
Violations may result in warnings, temporary suspension, or permanent account termination.

3. Adventure, Ride, & Activity Safety Disclaimer

XXTRA Seat helps users connect for outdoor adventures such as ATV/UTV rides, boating, fishing, hunting, and other activities. However:
We do not supervise, organize, control, or inspect any user meetups
We do not verify vehicles, equipment, terrain, or participant skill level
You participate in all activities at your own risk
Always follow local laws, vehicle manufacturer guidelines, and standard safety practices.
XXTRA Seat LLC is not responsible or liable for any injuries, accidents, property damage, equipment failure, wildlife encounters, or death related to user-organized activities.

4. Subscription & Billing

XXTRA Seat operates using an auto-renewing subscription model.
Subscriptions renew automatically unless canceled at least 24 hours before renewal
Billing is handled by the Apple App Store or Google Play Store
Your account is charged for renewal within 24 hours before the end of the current period
You can manage or cancel your subscription through your Apple or Google account settings
XXTRA Seat does not provide refunds for unused time, partial billing cycles, or accidental renewals
All refund requests must be directed to Apple or Google per their policies.

5. User Content & Ownership

You retain ownership of content you upload, including photos, bios, and messages. By uploading content, you grant XXTRA Seat a license to:
Display the content within the app
Modify or resize content for app functionality
Share content with other users as part of matching or discovery features
You are responsible for ensuring your content does not violate any intellectual property rights or contain prohibited material.

6. Prohibited Uses

You agree not to:
Use the Service for commercial advertising without permission
Upload malware, viruses, or harmful code
Reverse-engineer, alter, or interfere with the app
Use bots, scrapers, or automated tools
Collect or store personal data of other users without consent
Access unauthorized areas or attempt to breach security

7. Termination

We may suspend or permanently terminate your account if you:
Violate these Terms
Endanger other users or their safety
Engage in fraud, harassment, or illegal behavior
Misuse the platform or attempt to interfere with operations
Termination does not entitle you to subscription refunds.

8. Limitation of Liability

To the maximum extent permitted by law:
The Service is provided “as is” and “as available.”
We disclaim all warranties, express or implied.
We do not guarantee matches, safety, or results.
We are not responsible for losses, injuries, damages, accidents, or disputes between users.
Your sole remedy for dissatisfaction with the Service is to stop using it.

XXTRA Seat – CSAE (Child Sexual Abuse & Exploitation) Policy

Title: XXTRA Seat Policy on Child Sexual Abuse & Exploitation (CSAE)
Public Statement

XXTRA Seat strictly prohibits all forms of child sexual abuse and exploitation (CSAE). We maintain a zero-tolerance policy toward any content, behavior, communication, or activity that involves the sexualization, endangerment, grooming, or exploitation of a minor.

This includes, but is not limited to:

Sharing, requesting, or distributing any sexual or sexually suggestive content involving minors

Attempting to contact, solicit, or groom a minor for inappropriate purposes

Creating or participating in events or activities that place a minor at risk

Using the platform to facilitate trafficking, exploitation, or any illegal activity involving minors

Enforcement:
XXTRA Seat immediately reports any suspected CSAE activity to the National Center for Missing and Exploited Children (NCMEC) and other legally mandated authorities. Accounts involved in CSAE are permanently banned without warning.

Reporting:
Users can report any suspicious or harmful behavior directly through our in-app reporting tools or by emailing . All reports involving minors are escalated and acted on immediately.
